What is PMTA?
PMTA (Premarket Tobacco Application) is an application required by the FDA to be filed for the legal listing of any new tobacco product — including vaping devices and e-liquids — first marketed after February 15, 2007. The FDA reviews each application and can approve or deny the product based on its risks and benefits to the general public: an authorization means the agency finds the product "appropriate for the protection of public health."
Why it matters to B2B buyers
The practical consequence is simple: in the United States, a vape product without PMTA authorization is not legally marketable. Every element of the product — device, e-liquid, and how they are sold together — sits inside that regulatory boundary. For distributors and brand owners:
- Check authorization status for any product you plan to sell in the US, and keep documentation on file.
- The burden sits with the finished product's marketer — hardware manufactured for OEM/ODM partners is specified, branded and authorized by the brand that sells it, so PMTA planning belongs in your project timeline from day one.
- Lead times are long. PMTA review is measured in months to years, which is why many brands run US and non-US product lines in parallel.
